The online shop is operated by:

Data Veu (Pty) Ltd
Registration Number: 2013/106170/07

3.2 Product photographs are for illustrative purposes and actual products may vary slightly in colour, appearance, packaging or finish.

3.3 Product specifications may change where a manufacturer or supplier makes changes.

3.4 If a product has a material difference from the description provided on the Website, the customer may have rights under applicable consumer legislation.

3.5 Product availability is subject to stock availability.

3.6 Products may become unavailable before an order is processed.

3.7 Where a product is unavailable after an order has been placed and paid for, Data Veu will contact the customer and may offer:

  • a suitable alternative;

  • a revised delivery date; or

  • a refund where applicable.

4. PRICING

4.1 All prices displayed on the Website are in South African Rand (ZAR).

4.2 Unless otherwise stated, prices include applicable VAT where Data Veu is required to charge VAT.

4.3 Delivery charges may be charged separately and will be displayed before the customer completes the purchase where reasonably possible.

4.4 Data Veu reserves the right to change prices at any time before an order is accepted.

4.5 Once an order has been accepted and payment successfully processed, the customer will generally be charged the price displayed at the time of purchase, subject to obvious pricing errors and applicable law.

4.6 If an obvious pricing error occurs, Data Veu may contact the customer before fulfilling the order.

4.7 If the customer does not wish to proceed with the corrected price, the order may be cancelled and any applicable refund will be processed.

5. PLACING AN ORDER

5.1 Customers may place orders through the Data Veu online shop.

5.2 When placing an order, the customer must provide accurate information, including:

  • full name;

  • delivery address;

  • telephone number;

  • email address; and

  • payment information where required.

5.3 The customer is responsible for checking all order information before completing the purchase.

5.4 An order is not considered accepted until Data Veu has received and successfully processed the order and payment, subject to any required verification.

5.5 Data Veu may contact the customer to verify an order where reasonably necessary.

5.6 Data Veu reserves the right to decline or cancel an order where reasonably necessary, including where:

  • the product is unavailable;

  • payment cannot be verified;

  • fraudulent activity is suspected;

  • an obvious pricing or product description error occurred;

  • the delivery address cannot reasonably be serviced;

  • the order contains an unreasonable quantity suggesting resale or abuse; or

  • circumstances outside Data Veu’s reasonable control prevent fulfilment.

6. PAYMENT

6.1 Payment must be made using one of the payment methods made available through the Website.

6.2 Orders will generally only be processed after payment has been successfully received or authorised.

6.3 Data Veu may use third-party payment processors.

6.4 Data Veu does not ordinarily receive or store full bank-card details where payment is processed through a third-party payment gateway.

6.5 Customers must ensure that sufficient funds are available to complete the transaction.

6.6 If payment is reversed, disputed, charged back or otherwise not successfully received, Data Veu may place the order on hold while the payment issue is investigated.

7. ORDER CONFIRMATION

7.1 After placing an order, the customer may receive an electronic order confirmation.

7.2 Customers should check the confirmation for:

  • products ordered;

  • quantities;

  • prices;

  • delivery details; and

  • customer information.

7.3 If an error is identified, the customer should contact Data Veu as soon as possible.

7.4 Data Veu cannot guarantee that an order can be changed once processing or dispatch has started.

8. SHIPPING AND DELIVERY

8.1 Data Veu will arrange delivery using its own delivery services or an independent courier or logistics provider.

8.2 Delivery timeframes displayed on the Website are estimates unless a specific delivery date has been expressly agreed.

8.3 Delivery times may be affected by:

  • stock availability;

  • supplier delays;

  • courier delays;

  • public holidays;

  • weekends;

  • weather;

  • incorrect delivery information;

  • remote delivery locations;

  • customs or regulatory requirements where applicable; and

  • circumstances beyond Data Veu’s reasonable control.

8.4 Customers must provide a complete and accurate delivery address.

8.5 Customers are responsible for ensuring that someone is available to receive the delivery where required.

8.6 Where a courier is unable to deliver because the customer provided an incorrect address or no authorised recipient is available, additional delivery charges may apply where permitted and disclosed.

8.7 Data Veu will not intentionally delay delivery without reasonable cause.

9. DELIVERY TO REMOTE AREAS

9.1 Certain remote or outlying areas may attract additional delivery charges.

9.2 Where an additional charge applies, Data Veu will communicate the charge to the customer before dispatch where reasonably practicable.

9.3 Data Veu may use a different courier or delivery method for remote areas.

9.4 Delivery times to remote areas may be longer than standard delivery times.

10. INSPECTION ON DELIVERY

10.1 Customers should inspect packages as soon as reasonably possible after delivery.

10.2 If packaging appears visibly damaged, customers should photograph the packaging and product before disposing of the packaging.

10.3 If a product is damaged during delivery, the customer should notify Data Veu as soon as possible.

10.4 Customers should retain the original packaging where a return, inspection or warranty claim may be required.

10.5 Failure to report visible damage immediately does not automatically remove statutory consumer rights.

11. INCORRECT PRODUCT DELIVERED

11.1 If Data Veu sends the wrong product, the customer should contact Data Veu as soon as possible.

11.2 Data Veu will investigate the error and, where appropriate, arrange for the incorrect product to be returned.

11.3 Where the incorrect product was supplied due to a Data Veu fulfilment error, Data Veu will arrange a reasonable remedy without charging the customer for the correction.

11.4 Depending on the circumstances, the remedy may include:

  • replacement with the correct product;

  • exchange;

  • repair where appropriate; or

  • refund.

12. DAMAGED PRODUCTS

  • photographs of the shipping label;

  • order number; and

  • a description of the damage.

12.3 Data Veu may investigate the damage with the courier, supplier or manufacturer.

12.4 Where the product is defective or damaged in circumstances giving rise to a statutory consumer remedy, Data Veu will provide the remedy required by applicable law.

13. RETURNS FOR CHANGE OF MIND

13.1 Where applicable, customers may have a right to return certain goods where they change their mind, subject to the requirements and exclusions contained in the Consumer Protection Act 68 of 2008.

13.2 Where a statutory cooling-off period applies to the transaction, the customer may exercise the applicable right within the legally prescribed period.

13.3 Where a customer voluntarily returns a product outside a statutory right, Data Veu may offer an exchange or credit at its discretion.

13.4 A change-of-mind return may be subject to reasonable conditions permitted by law, including the condition of the product and whether the product can lawfully be resold.

13.5 Statutory rights relating to defective, unsafe or incorrectly supplied goods are not affected by this clause.

14. GOODS THAT CANNOT ORDinarily BE RETURNED

Certain goods may not be eligible for return in circumstances permitted by law, including products that:

  • cannot reasonably be returned for health or hygiene reasons after unsealing;

  • are sealed goods that have been unsealed where the law permits exclusion of the return right;

  • are digital products or content where applicable statutory requirements for waiver or commencement have been met; or

  • are otherwise excluded by applicable law.

Where a product is excluded from a statutory cooling-off or return right, this does not necessarily exclude rights relating to defective, unsafe or incorrectly supplied goods.

15. DEFECTIVE PRODUCTS

15.1 Customers have statutory rights regarding defective goods where the Consumer Protection Act applies.

15.2 Where a product is defective, the customer may be entitled to a remedy such as:

  • repair;

  • replacement; or

  • refund,

depending on the circumstances and applicable law.

15.3 Customers should notify Data Veu as soon as reasonably possible after discovering a defect.

15.4 Data Veu may require the product to be returned for inspection or assessment.

15.5 Products should not be altered, repaired or modified by an unauthorised person before a warranty or defect claim is assessed, unless reasonably necessary to prevent further damage.

16. PRODUCT WARRANTY

16.1 Certain products may include a manufacturer’s warranty.

16.2 Manufacturer warranties are subject to the applicable manufacturer’s terms.

16.3 Data Veu will assist customers with warranty claims where reasonably possible.

16.4 A warranty does not normally cover damage caused by:

  • misuse;

  • negligence;

  • accidental damage;

  • unauthorised modifications;

  • incorrect installation;

  • abnormal use;

  • water or liquid damage where not covered;

  • electrical damage caused by unsuitable power supplies;

  • normal wear and tear; or

  • use contrary to the manufacturer’s instructions.

16.5 Nothing in this clause removes any statutory warranty or consumer right that cannot lawfully be excluded.

  • product name;

  • reason for return; and

  • photographs where relevant.

17.3 Data Veu will provide return instructions where a return is approved.

17.4 Customers should not send products to an address other than the return address supplied by Data Veu.

17.5 Products should be securely packaged to prevent damage during return transport.

17.6 Customers should retain proof of postage or courier collection until the return has been finalised.

18. RETURN SHIPPING COSTS

18.1 Where the return is due to a Data Veu error, defective product, incorrect product or another circumstance for which Data Veu is responsible, Data Veu will arrange or reimburse reasonable return delivery costs where required by law.

18.2 Where a customer voluntarily returns a product for reasons such as change of mind and the law permits the customer to bear return costs, the customer may be responsible for the return delivery cost.

18.3 Data Veu will communicate any applicable return delivery costs before processing the return where reasonably practicable.

19. REFUNDS

19.1 Where a refund is legally due, Data Veu will process the refund within the applicable period prescribed by law.

19.2 Refunds will generally be made using the same payment method used for the original transaction, unless another method is agreed.

19.3 Data Veu may require verification of the customer’s identity or payment details before processing a refund.

19.4 Refund processing times may depend on the payment provider or financial institution.

19.5 Data Veu is not responsible for delays caused solely by a bank or third-party payment provider after Data Veu has processed the refund.

20. REFUNDS FOR OUT-OF-STOCK PRODUCTS

20.1 If a customer has paid for a product that cannot be supplied because it is unavailable, Data Veu may offer:

  • an equivalent alternative;

  • a later delivery; or

  • a refund.

20.2 If the customer chooses a refund, it will be processed in accordance with applicable law.

21. ORDER CANCELLATION BEFORE DISPATCH

21.1 Customers may request cancellation of an order before the order has been dispatched.

21.2 Data Veu will make reasonable efforts to stop an order where cancellation is requested before dispatch.

21.3 Once an order has been dispatched, the normal return procedure may apply.

21.4 Cancellation rights provided by applicable consumer legislation remain unaffected.

22. DIGITAL PRODUCTS AND ELECTRONIC SERVICES

22.1 Where the online shop includes digital products, licences, subscriptions or electronically supplied services, separate terms may apply.

22.2 Customers may lose certain cancellation rights where legally permitted after digital content has been supplied or performance has commenced, provided the required statutory conditions have been met.

22.3 Nothing in this clause excludes rights relating to defective or non-conforming digital goods or services where such rights apply.

23. SUBSCRIPTIONS AND RECURRING ORDERS

23.1 Where products or services are supplied on a recurring subscription basis, the customer will be informed of the applicable billing cycle and charges.

23.2 Customers may cancel subscriptions in accordance with the applicable subscription terms and South African consumer law.

23.3 Recurring charges will cease after the effective cancellation date, subject to any lawful notice period or outstanding amounts.

23.4 Data Veu will not intentionally continue charging a cancelled subscription after the cancellation has taken effect.

24. FRAUDULENT OR SUSPICIOUS ORDERS

24.1 Data Veu may conduct reasonable fraud-prevention checks.

24.2 An order may be delayed or cancelled where there are reasonable grounds to suspect fraud, identity theft, payment fraud or unauthorised use of payment information.

24.3 Where an order is cancelled for fraud-prevention reasons after payment has been received, any applicable refund will be processed subject to verification and applicable law.

25. CUSTOMER RESPONSIBILITY FOR DELIVERY INFORMATION

25.1 Customers are responsible for providing accurate delivery information.

25.2 Data Veu is not responsible for delays or failed delivery caused by incorrect information supplied by the customer.

25.3 Where a parcel must be redirected because of incorrect information supplied by the customer, additional delivery charges may apply where permitted by law and disclosed to the customer.

27.2 Where the CPA applies, statutory consumer rights will apply to the relevant transaction.

27.3 Nothing in this Policy is intended to:

  • waive a statutory consumer right;

  • exclude a statutory remedy;

  • unfairly limit Data Veu’s obligations; or

  • contract out of a mandatory provision of South African law.

27.4 If any provision of this Policy conflicts with a mandatory provision of South African law, the mandatory legal provision will prevail.
